§1

 Definition of the Seller

 

1. The store is owned by

§2

 General provisions

1. The online store [hereinafter the Store] provides online retail services on the basis of these Rules and Regulations [hereinafter Rules and Regulations].

2. The Consumer [hereinafter the Customer] is a natural person involved with the Store in a legal transaction not directly relating to his or her business or professional activity. (Civil Code Article 22).

3. The Trader [hereinafter the Trader] is a person/entity/organisation involved with the Store in a legal transaction relating to their business or professional activity.

4. The Terms and Conditions form an integral part of the sale agreement with the Customer/Trader.

5. The prices listed in the Store are gross prices (inclusive of VAT).

6. The goods available in the Store are free from material defects and defects of title. The only exceptions are goods listed in Store auctions with material defects clearly indicated in their descriptions. Such objects can be purchased at a discount.

 

§3

Orders

 

1. Orders can be submitted in the following manner:

·         via the form available on the Store website (Customer basket);

·         via e-mail sent to the address provided on the Store website.

 2. An order can be fulfilled, if the Customer/Trader provides the Store with data making it possible to identify the Customer/Trader and recipient of goods. The Store acknowledges receipt of the order by sending an e-mail describing the order to the address given by the Customer/Trader during order placement. The Store has the right to refuse to accept the order, the right to limit payment options and the right to demand payment in advance, if there are well-founded doubts as to the authenticity and reliability of the data or method of payment.

3. The parties are bound by the information given on the Store website by each purchased product at the moment of order placement. This applies in particular to the price, description, features, elements of the product, date and method of delivery.

4. The information presented on the Store website does not constitute an offer under the Polish Civil Code. By placing an order the Customer/Trader makes an offer for the purchase of the goods.

5. By placing an order the Customer/Trader makes an offer to conclude a sale agreement for the products in question.

6. After submitting the order, the Store sends an e-mail with information about the following stages of order fulfilment:

·         After verifying the order, the Stores sends an e-mail to the Customer/Trader with information about order acceptance. Information about order acceptance constitutes the Seller’s acceptance of the offer referred to in §3(5) above and the moment the Customer/Trader receives the information, the sale agreement is considered to have been concluded.

7. After concluding the sale agreement, the Store confirms its terms and conditions by sending them to the Customer’s/Trader’s e-mail address or in writing to the address indicated by the Customer/Trader during order placement.

8. If the Customer/Trader chooses bank transfer as the payment method, the period for order fulfilment starts when the payment for the Customer’s/Trader’s order is credited to the bank account of the Store.

9. After receiving the payment the Store sends an e-mail to the address given by the Customer/Trader during order placement. The e-mail contains a link making it possible to download the purchased publication in PDF format.

10. The Store is liable to the Customer/Trader under the warranty provisions of the Polish Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93 as amended) for 24 months. A detailed description of the complaint procedure is included in §6 of these Terms and Conditions.

 

§4

Payments

 

1. The Customer/Trader can choose from among the following payment methods:

·         electronic payment through PayU S.A.

2. Delivery is provided by electronic means. The Store does not impose any additional charges for electronic delivery.

3. The product can be delivered only after it has been paid for.

 

§5

Product delivery

 

1. The product ordered from the Store shall be sent to the e-mail address given during registration.

2. The delivery deadline shall be extended by the period between order placement and the date on which the payment is credited to the bank account of the Store.

3. The product is sent automatically after the payment is credited to the Store through the PayU S.A. system.

4. The product shall be sent to the address given during registration within a maximum of 60 minutes (usually within 3 minutes) from the moment the payment is credited through the PayU S.A. system.

5. In reasonable cases delivery may be delayed, especially if there are well-founded doubts as to the authenticity and reliability of the data or method of payment. In such cases orders shall be fulfilled by a Store employee on working days (from Monday till Friday) between 9:00 and 15:00.

6. The Store shall not be liable for delays in the delivery caused by the Customer/Trader. In particular, the Store shall not be liable for any mistakes in the e-mail address given by the Customer/Trader to which the purchased product is to be sent.

7. The Customer/Trader shall receive an e-mail with a link to the purchased publication. The Customer/Trader is obliged to download the purchased file and save it on a hard drive (or other medium).

8. The Store automatically prevents new downloads of the purchased publication after the link has been used once.

9. The Customer/Trader may request the Store to resend the purchased publications within 24 months. The publications shall be sent to the e-mail address given during order placement. The only exception is a clear, undoubted error in the e-mail address.

 

 

§6

Complaints

 

1. In the case of non-compliance of the product with the sale agreement the Customer/Trader should return the product to the Store with a description of non-compliance. The cost of the return shall be covered by the Customer/Trader. The Customer/Trader should sent the product back to:

2. The Store shall respond to the Customer’s/Trader’s complaint within 14 days from the moment the product is returned with a description of non-compliance.

3. If a relevant complaint makes it necessary for the Store to send the Customer/Trader a new product or to rectify the non-compliance, any cost of delivery (if applicable) shall be covered by the Store.

4. Each Customer/Trader may resort to out-of-court complaint handling procedures and redress. In this respect the Customer/Trader may use mediation. A list of permanent mediators and mediation centres is made available by the president of the competent Regional Court (sąd okręgowy). 5. The Store shall be liable to the Customer/Trader under the warranty provisions of the Polish Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93 as amended) for 24 months.

6. A complaint form can be found in Annex 2 to these Terms and Conditions.

 

§7

Right of withdrawal

 

1. Under the Consumer Rights Act of 30 May 2014, the Customer has the right to withdraw from the agreement without giving any reason.

2. The right of withdrawal shall be effective, if within 14 days from receiving the product the Customer sends a notice of withdrawal. To comply with the deadline, it is sufficient for the Customer to submit the notice before the deadline expires. The notice can be submitted by means of a form annexed to the Consumer Rights Act of 30 May 2014 (Annex 1 to these Terms and Conditions) or by e-mail sent to cns.sklep@wuwr.pl.

3. The cost of returning the product to the Store within 14 days from submitting the notice of withdrawal shall be covered by the Customer. The Customer shall return the product to: cns.sklep@wuwr.pl

4. The Store shall verify the condition of the product within 3 working days of receiving it.

5. The Store shall reimburse the Customer, using the same method of payment as the Customer. In the case of card payments, reimbursement shall be made into the card account.

6. The Customer shall cover all direct costs of returning the purchased product (e.g. costs of postage, packaging, securing the product).

 7. The Customer does not have the right to withdraw from the following agreements:

·         agreement for the provision of digital content not recorded on a physical medium, if the provision began with the Customer’s explicit consent before the withdrawal deadline and after the Store informed the Customer about the loss of right of withdrawal;

·         agreement for the provision of services, if the Store has provided a complete service with the explicit consent of the Customer, who was informed before the start of the provision that after the provision of the service the Customer would lose the right of withdrawal;

·         agreement for the delivery of newspapers, periodical or journals, with the exception of subscription agreements.

8. Traders do not have the right of withdrawal without giving any reason.

 

§8

Intellectual property

1. The material published on the Store website (including photographs and descriptions of products) may not be used without the Store’s written consent.

 

§9

Privacy policy

1. By placing the order the Customer agrees to have his or her personal data processed only for the purpose of order fulfilment.

 2. The processing of personal data shall be in accordance with the Data Protection Act of 29 August 1997 (Journal of Laws of 2002, no. 101, item 926 as amended).

 3. The Customer has the right of access to his or her personal data as well as the right to correct them, demand that their processing be ended and object to their processing.

 

§10

Technical means

1. After making the payment the Customer/Trader shall receive an e-mail, sent to the address given during order placement, with a link to a download of the purchased product.

2. All publications sold by the Store shall be delivered to the Customer/Trader in electronic form.

3. All publications sold by the Store shall be delivered to the Customer/Trader in PDF format. In order to be able to read the publication, the Customer/Trader needs software making PDF file viewing possible. The Store recommends the free Acrobat Reader software (to be downloaded from http://get.adobe.com/pl/reader/ ).

 

4. Each publication sold by the Store is verified with regard to correct display, compatibility and possible errors in the Acrobat Reader software (to be downloaded from http://get.adobe.com/pl/reader/ ).

5. The Store guarantees that the publication will be displayed correctly in Acrobat Reader version 9.0 or higher.

6. Each publication sold by the Store has a number of features making it impossible for the Customer to:

                - copy the contents of the publication,

                - comment on the publication inside the PDF document,

                - sign the publication inside the PDF document,

                - transfer the general page layout of the PDF document to templates.

 These protecting features do not in any way prevent the Customer from using the publication; their objective is to limit illegal distribution.

 7. The documents are encrypted by means of the AES 128-bit algorithm. This protecting feature does not in any way prevent the Customer from using the publication; its objective is to limit illegal distribution.

8. The Store does not limit the possibilities of reading the publications purchased by the Customer. Reading is possible on any device with the required PDF viewing software (computer, mobile phone, tablet etc.).

 

 

§11

Entry into force of and changes to the Terms and Conditions

 

1. The Terms and Conditions enter into force on the day they are published on the Store website.

2. These Terms and Conditions are subject to change.

3. Changes to the Terms and Conditions shall be published on the Store website.

4. Information about changes to the Terms and Conditions shall be e-mailed to the Customer/Trader to the address given in the order.

5. Changes to the Terms and Conditions enter into force 14 days after the day of their publication as referred to in §11(3).

6. The Store considers the changes to the Terms and Conditions to have been accepted by the Customer/Trader, if the Customer/Trader does not withdraw from the agreement by the end of the period referred to in §11(5).

7. Any matters not covered by these Terms and Conditions shall be governed by the Polish law, in particular by the provisions of the Civil Code and the Consumer Rights Act of 30 May 2014.
